PA Governor To Sign Gun Control Bill

Pennsylvania’s Democratic governor pledged this week to sign a pending state law increasing the mandatory surrender of guns in some domestic situations.

The measure that Gov. Tom Wolf is backing, HB 2060, was approved 131-62 by the Pennsylvania House last week and 43-5 by the Senate on Wednesday. The aim of the proposal is to pump up the existing surrender gun policy of convicted abusers in the Commonwealth and the Democrat vowed to sign it as soon as it hits his desk.

“For years, victims and advocates have fought tirelessly for passage of this commonsense and urgently needed reform,’ said Wolf in a statement. “Today is about them but I am proud of their work and to have stood with them in this fight.”

The bill would make those subject to a misdemeanor domestic violence conviction or a final Protection From Abuse order relinquish their guns and ammunition to police or a gun shop within 24 hours of a hearing.  Current law, which allows more judicial discretion on ordering surrenders, grants a 60-day window and the ability for those subject to such surrender orders to give their arms to a third-party, such as a friend or family member, to hold. An amendment by state Sen. John Eichelberger, R-Blair Township, to continue to allow friends to hold guns was defeated 39-9. Those who don’t comply face two years in prison and a fine of as much as $5,000.

Second Amendment groups argue that spurious orders have in the past been filed vindictively and that gun owners can easily lose their firearms and right to keep and bear arms pending lengthy legal appeals and, even if they get their guns back, could leave them on the hoof for thousands in storage fees. Further, they point out that police could sell guns stored with them after a year as surplus property and keep the money.

National and local anti-gun groups have stumped hard for the effort, holding a myriad of press conferences, buying billboard ads, flooding the halls of the Statehouse with activists on the eve of votes on the legislation, and driving calls and digital messages to lawmakers urging them to back HB 2060.

As for Wolf — running a race for a second term in which polls put him ahead of his Republican challenger, Scott Wagner, by double-digit numbers — he has promised to work for more gun control in the future. “There is more work to be done, and I look forward to working with the House and Senate to enact additional commonsense reforms to reduce violence, support victims and keep guns out of the hands of dangerous individuals,” he said Wednesday.

The NRA, who endorsed Wagner on Tuesday and has consistently rated Wolf poorly on Second Amendment issues, says the Democrat “strongly opposes state preemption and supports granting municipalities the ability to enact gun control ordinances. In addition, he supports banning commonly owned rifles and ammunition.”

      Unfortunately probably so, that must be addressed to the courts and resolved as a total package. Bugg the hell out of your represenatives to address the total package if they want to be sincere about Domestic Abuse issues.

      Sarge, believe you are missing a qualifying point here, those whom are and have committed domestic violence are the ones affected. WE want well qualified, mentally stable gun owners in a time of SHTF situations. I am addressing this from well decorated experiences. We do not need a loose nut behind a trigger or on a grenade pin. You have to be able to CONTROL your emotions and actions PERIOD. This is the only arena I support for CRIME Control. IT is an operator thing, NOT the inert gun and bullet.

These “DECENT” honest citizens as you state have placed themselves in this state of contention. Remember, it is the OPERATOR of a gun that harms, their uncontrolled emotions probably got them qualified as a “PROBLEM”. This is a start for violence control. Now the legislators MUST find a way to enact it on the street scene which is where the real threats are.

    And sure enough, FBI statistics for 2012 show 678 people were murdered that year with “personal weapons” (hands, fists, and feet), 518 were killed with blunt objects (hammers would be in that group) while rifles (322) and shotguns (303) lagged behind.

    Well if there is a domestic violence person going to buy a firearm they would get blocked by the background checks in place. If there is some one that becomes a domestic abuser then yes they do need to have their firearm taken as it shows no self control only will to hurt others. But until you get rid of the criminals that have firearms then you are spinning your wheels hurting the law abiding folks. So the real question should be do we ban firearms that are a tool in the right hands or do we ban democrats that do more harm to the nation as a whole. Seems most of the gun violence is in democrat controlled areas with gun free zones.

    It is not about reducing crime. It is about incrementally reducing the number of armed Americans using fill good laws that will have ZERO affect on crime.
    Crime numbers will go up as these fill good laws are implemented.

    If you sit and complain, and don’t vote pro America you are just as much of the problem as the Democrats/Socialists.

    I do strongly support the second amendment always have been a strong supporter of the right to keep and bear arms. I also understand there must be a balance to the ability of the victim in such cases to be able to defend themselves, that is the absolute meaning of the amendment. I also understand that a domestic abuser has the absolute control over the victim and must be stopped from such abuse, if said abuse can be proved beyond reasonable doubt. We have seen recently of such abuses and it is not to the reasonable doubt but to the accusation. There must be a complete investigation of said charges and there must also be an adjudication of absolute guilt. Without that you have nothing more than “he said she said” ie Brett Kavanaugh. This could be an easy way for one person to take away the constitutional; right of another through nothing more than inuendo and accusation. There must be middle ground and I am sure there is. From a life long shooter and gun rights advocate
